Website Terms and Conditions

These Terms and Conditions (the “Terms”) govern your use of the Career Elevation website (the “Site” or “Website”). By accessing and using this Website, you agree to be bound by these Terms, which form a binding agreement between you and Career Elevation, a business of VBI Enterprises Pty Ltd (ABN 41 165 508 001) (“we”, “us”, “our”).

We may amend these Terms at any time by updating this page. Your continued use of the Website after any change means you accept the revised Terms. You must use the Website in accordance with these Terms and all relevant laws, and you are responsible for ensuring that any employees, contractors or agents who access the Website on your behalf also comply.

Your obligations

  • forward any resources provided through your enrolment to third parties via email or any other channel;

  • use or attempt to use the Website for any illegal or fraudulent purpose, or to facilitate illegal or fraudulent activity;
  • interfere with, disrupt or place an undue burden on the Website or its servers and networks;

  • act in any way that harms the reputation of Career Elevation, including linking to the Website from another site in a detrimental manner.

You must not attempt to breach the security of the Website or disrupt its normal operation. Fees and payment

By enrolling in a course or purchasing a product or service through the Website, you agree to pay the full amount of the applicable fees.

Refunds are handled in accordance with our Refund Policy.

While we endeavour to keep the information on the Website current and accurate, to the fullest extent permitted by law we do not guarantee that:

  • the prices displayed will remain current or match a price quoted to you in an order or enrolment form;
  • the Website will be free of errors or defects;
  • the Website will be available at all times;
  • bookings or enrolments made through the Website can be confirmed consistently;
  • messages transmitted through the Website will be delivered promptly, or at all;
  • information you receive or provide through the Website will be secure or confidential;
  • any information provided through the Website, including the content of courses, resources or blogs, will be accurate or complete;
  • you will achieve any particular outcome from using our resources, courses or other materials.

We reserve the right to: modify any information or functionality on the Website at any time without notice (including product descriptions and prices); remove user-generated content that is illegal, obscene, infringing, or not aligned with our interests; and assess, review, filter and evaluate prospective and current students or customers and determine whether to grant access to our products, services and resources.

Intellectual property

Career Elevation owns the Website and all materials contained in it, including but not limited to presentations, blog content, resources, courses, checklists, text, graphics, logos, design elements, icons, images, audio and video recordings, pricing information, downloads and software. We reserve all rights in any intellectual property we own or licence, and no rights are expressly granted to you.

You may make a temporary electronic copy of all or part of the Website solely for the purpose of viewing it. You must not otherwise reproduce, transmit, adapt, distribute, sell, modify or publish the Website or any of its content without our prior written consent, except as permitted by law.

Disclaimer

Career Elevation does not accept responsibility for any loss or damage to computer systems, mobile phones or other electronic devices, hardware or software resulting from your use of the Website. You should take your own precautions to ensure that the way you access the Website does not expose you to risks such as viruses, malicious software or other interference.

Privacy

You agree to comply with, and acknowledge that your personal information is handled in accordance with, the Career Elevation Privacy Policy.

Reporting misuse

If you observe any misuse of the Website, encounter errors in the materials presented, or have difficulty accessing or using the Website, please contact us promptly using the contact details or the form provided on our Website.

Dispute resolution

If a dispute arises between you and us, you agree to first contact us at admin@careerelevation.com.au to try to resolve the matter. If we are unable to resolve it, you agree to seek resolution through a dispute resolution process acceptable to both parties before commencing legal proceedings.

General

Governing law. This agreement is governed by the laws of Queensland, Australia.

Jurisdiction. Each party irrevocably submits to the exclusive jurisdiction of the courts of Queensland, Australia and any courts of appeal, and waives any objection to proceedings being brought in those courts on the basis of an inconvenient forum.

Amendments. These Terms may only be modified by Career Elevation in accordance with the provisions set out in them.

Waiver. No party will be taken to have waived any right unless the waiver is in writing and signed by the party granting it.

Further acts. Each party must promptly do any further acts and execute any further documents reasonably required by law or requested by another party to give effect to these Terms.

Assignment. A party must not assign, novate or otherwise transfer any of its rights or obligations under these Terms without the prior written consent of the other party.

Entire agreement. These Terms are the entire agreement between the parties and supersede any prior negotiations, arrangements, understandings or agreements relating to their subject matter.
